These Terms and Conditions (“Agreement”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and CodeTrade.io (“Company,” “we,” “us,” or “our”) regarding the access and use of our mobile application (“the App”), which is designed to integrate with Open edX platforms.
By downloading, installing, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by the terms and conditions set forth in this Agreement. If you do not agree to these terms, you must immediately cease using the App and uninstall it from your device.
1. DEFINITIONS
- 1.1. “App” refers to the proprietary mobile application developed by CodeTrade.io for users of Open edX platforms.
- 1.2. “User” refers to any individual or entity that downloads, installs, accesses, or uses the App.
- 1.3. “Authentication Data” refers to the server URL and authentication token provided by the User to access their Open edX platform through the App.
- 1.4. “User Data” refers to any information collected from or about the User, including but not limited to location, device details, and activity within the App.
- 1.5. “Third-Party Services” refers to external platforms, services, or software that may interact with the App, including Open edX and analytics providers.
2. LICENSE GRANT
- 2.1. Subject to compliance with this Agreement, CodeTrade.io grants the User a limited, non-exclusive, non-transferable, revocable license to use the App for its intended purpose.
- 2.2. This license does not grant the User any ownership rights or intellectual property rights in the App or its underlying code.
- 2.3. The User shall not:
- (a) Modify, reverse-engineer, decompile, or disassemble any part of the App.
- (b) Use the App for any illegal or unauthorized purposes.
- (c) Attempt to gain unauthorized access to any part of the App or related services.
3. USER OBLIGATIONS AND RESTRICTIONS
- 3.1. The User acknowledges and agrees to:
- (a) Provide accurate and lawful Authentication Data.
- (b) Maintain the confidentiality of their authentication credentials.
- (c) Not use the App in violation of any applicable laws, including but not limited to data protection laws.
- 3.2. CodeTrade.io reserves the right to restrict, suspend, or terminate access to the App if the User is found to be in violation of this Agreement.
4. DATA COLLECTION AND PRIVACY
- 4.1. The App collects certain User Data, including but not limited to:
- (a) Device information (model, operating system, unique device identifiers).
- (b) Location data for analytics and security purposes.
- (c) App usage data and interactions.
- 4.2. The User acknowledges that such data collection is essential for the functionality and improvement of the App.
- 4.3. The collection, use, and protection of User Data are governed by our Privacy Policy.
5. INTELLECTUAL PROPERTY RIGHTS
- 5.1. The App and all associated intellectual property, including but not limited to trademarks, copyrights, trade secrets, and proprietary algorithms, are the sole property of CodeTrade.io.
- 5.2. The User may not copy, reproduce, distribute, or create derivative works based on the App without prior written consent from CodeTrade.io.
6. LIMITATION OF LIABILITY
- 6.1. The App is provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind. CodeTrade.io does not guarantee uninterrupted or error-free operation of the App.
- 6.2. To the maximum extent permitted by law, CodeTrade.io shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from the use of the App.
7. TERMINATION
- 7.1. CodeTrade.io reserves the right to terminate or suspend access to the App at any time without notice if the User violates this Agreement.
- 7.2. The User may discontinue use of the App at any time by uninstalling it from their device.
8. GOVERNING LAW AND DISPUTE RESOLUTION
- 8.1. This Agreement shall be governed by and construed in accordance with the laws of Jurisdiction, without regard to its conflict of law provisions.
- 8.2. Any disputes arising from this Agreement shall be resolved through binding arbitration in Jurisdiction, unless prohibited by law.
